Your rights

Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent already given at any time. The legality of data processing carried out up to the withdrawal remains unaffected by the withdrawal.

Right of objection to data collection in special cases as well as to direct advertising (Art. 21 GDPR)
If data processing is carried out on the basis of Art. 6(1)(e) or (f) of the GDPR, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. If you object, we will no longer process your affected data, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the assertion, exercise or defense of legal claims (objection pursuant to Art. 21(1) of the GDPR). If your personal data is processed to conduct direct marketing, you have the right to object at any time to the processing for such marketing purposes; this also applies to profiling insofar as it is related to such direct marketing (objection pursuant to Art. 21(2) GDPR).

Right to complain to the competent supervisory authority
In the event of violations of the GDPR, you have the right to file a complaint with a supervisory authority, in particular in the member state of your habitual residence, your place of work, or the place of the alleged violation. Right to data portability
You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to yourself or to a third party in a commonly used, machine-readable format. If you request the direct transfer to another controller, this will only take place if it is technically feasible.

Access, rectification and erasure
Within the framework of the applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, their origin and recipients, as well as the purpose of data processing, and if applicable, the right to rectification or deletion of these data.

Right to restrict processing
You have the right to request the restriction of the processing of your personal data, in particular if you dispute the accuracy of the data, the processing is unlawful, we no longer need the data but you need it to assert legal claims, or if you have filed an objection pursuant to Art. 21(1) GDPR and the assessment is still pending.

You can contact us at any time regarding all of these rights: briefkasten@schwanenwik.de.

The use takes place based on your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. Without your consent, Google Analytics will not be loaded. Consent can be withdrawn at any time. Data collection on this website

Server log files
The provider of the sites automatically collects and stores information in so-called server log files that your browser automatically transmits to us. These include:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

No merging of this data with other data sources is carried out. The collection is based on Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website in a technically error-free manner and optimizing it.

Contact forms
If you submit a request to us using one of our forms (contact form, brochure request form, search profile), your details, including the contact details you provide, will be stored by us for the purpose of processing the request and in case of follow-up questions. You will receive a confirmation of receipt by email. We will not share this information without your consent.

The processing takes place on the basis of Art. 6(1)(b) GDPR, provided that your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in effectively processing the requests submitted to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that it has been requested. The data remains with us until you request us to delete it, withdraw your consent, or the purpose for data storage no longer applies. Compulsory statutory provisions, in particular retention periods, remain unaffected.

Request by email or phone
If you contact us by email or phone, your request, including all personal data derived therefrom, will be stored and processed by us for the purpose of processing your request. The legal basis is Art. 6(1)(b) GDPR or Art. 6(1)(f) GDPR.

Online withdrawal
Through our “Cancellation Policy” page, you can cancel a real estate agency contract online. In doing so, we process the data you provide (name, email address, property, and, if applicable, your message) as well as the date and time of receipt to process the cancellation and confirm receipt to you. The legal basis is Art. 6(1)(c) GDPR in conjunction with § 356a BGB.

Section 8

Customer management with Propstack

To process your inquiries and to manage customer data, search profiles, and real estate listings, we use the software Propstack. The provider is Propstack GmbH, Invalidenstr. 65, 10557 Berlin.

When you submit one of our forms, the data provided there, such as your title, first and last name, email address, phone number, your message, and information about your real estate preferences, will be stored in Propstack and assigned to the relevant advisor. Additionally, we store the source of the request, i.e., for example, website, real estate portal, or advertising campaign, as well as, if applicable, the click ID and the campaign name from the “Assigning requests to advertising campaigns” section.

The purpose of the processing is the processing and answering of your request, the preparation and execution of real estate contracts, and the matching of suitable real estate offers. The legal basis is Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR based on our legitimate interest in efficient customer support.

Propstack operates as a processor for us; we have entered into a contract with the provider for processing orders pursuant to Article 28 of the GDPR. We store your data for as long as necessary for the stated purposes and then delete it in accordance with legal retention periods.

Real estate offers by email
If you have provided us with a search profile, we will inform you by email about properties that meet your criteria. This email is sent to fulfill your search request. You can object to it at any time, for example by sending a message to briefkasten@schwanenwik.de. The legal basis is Article 6(1)(b) GDPR.

Section 9

Google Maps

On individual pages, we embed maps from the Google Maps service. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The map is only loaded when you agree to it in the cookie banner or directly on the map. Your IP address is transmitted to Google and usually stored on a server in the USA.

The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG; the consent is revocable at any time. The data transfer to the USA is based on the EU Commission’s standard contractual clauses and the “EU-US Data Privacy Framework”. Further information: policies.google.com/privacy.

Section 10

Accessibility tool (Ally)

To allow you to customize the presentation of our website to your needs (e.g., larger fonts, higher contrast, reading mask), we integrate the tool “Ally” from Elementor Ltd., Israel. When you visit our pages, your browser loads the tool from the provider’s servers (cdn.elementor.com); in this process your IP address is transmitted to Elementor. Your selected settings are stored locally in your browser. Analysis purposes are disabled.

The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in barrier-free access to our website. For Israel, there is an adequacy decision by the EU Commission. Further information: elementor.com/about/privacy.

Section 11

Address completion in forms

In our sales inquiry form, we help you enter the property address: As you type the street, we suggest suitable addresses and automatically fill in the street, house number, postcode and location.

The suggestions come from the address service Photon, which is based on the open geodata from OpenStreetMap. The service is operated by komoot GmbH, Potsdam. Your IP address is not transmitted to the provider: The request is not sent by your browser, but by our own web server. Only the characters you enter in the address field are transmitted; they are not linked to your person and do not contain the other data from the form. Cookies are not set for this function.

To keep the number of requests low, we store the search results for a search term on our server for 24 hours. This intermediate storage does not contain any personal data.

The legal basis is Article 6(1)(f) of the GDPR. Our legitimate interest lies in the correct and convenient collection of the property address. Use is voluntary; you can fill in the address fields manually at any time without selecting a suggestion.
